THE DAMAGE

The storm is the easy part. This is the claim.

A denied or underpaid claim isn’t about the weather — it’s about the damage the carrier won’t pay for. Torn-off roofs, water through the ceiling, flooded ground floors, hail-struck slopes.

Representative peril imagery — the damage types that drive Florida property claims.

Punta Gorda has taken two of the worst hits on Florida’s Gulf coast. Charley’s eyewall came ashore over the city as a Category 4 in August 2004, and eighteen years later Ian pushed its eye across Charlotte Harbor in 2022, driving catastrophic surge into the Punta Gorda Isles canals and the harborfront. Homes rebuilt after Charley flooded again under Ian, and the resulting claims raise the hardest question in Florida property insurance: which storm, and which peril, owes for the damage?

What Punta Gorda claims turn on

Surge is flood, and flood is excluded from every homeowners policy — it needs NFIP or private flood coverage. Wind is covered, behind a hurricane deductible that is a percentage of the home’s insured value, not the loss. In the canal communities a home often takes surge below and wind above, and the flood carrier and the wind carrier each point at the other. Where two storms hit the same property, insurers also argue over which one caused what — an allocation fight that can close a claim without payment.

The law here

Florida gives you one year from the date of loss to give notice of a hurricane claim and 18 months for a supplemental claim (§ 627.70132, as amended by SB 2-A in 2023), and the carrier must pay or deny within 60 days of a complete proof of loss (§ 627.70131). For storms that are already years past, those notice windows have generally closed — but a claim you already filed that was denied or underpaid can still have options, and the deadline to sue on a filed claim is longer. These are general figures — confirm the current statutes and your own dates with counsel before relying on them.

FLOOD-ZONE MAP

Where the high-risk flood zones are in Punta Gorda

This is Punta Gorda drawn live from FEMA’s National Flood Hazard Layer. Every shaded area is a Special Flood Hazard Area — a high-risk zone where a federally backed mortgage requires flood insurance, and the first thing a carrier checks after a water loss. Your homeowners policy does not cover flood; that takes a separate NFIP or private flood policy. Pan and zoom to your street to see your zone.

FEMA FLOOD ZONES · PUNTA GORDA Loading live data…
Zone VE
Coastal high-hazard. Storm surge with waves on top — the most dangerous zone, along the open water.
Zone AE
The 1%-annual-chance floodplain (the “100-year” zone). FEMA sets a Base Flood Elevation here.
A / AH / AO
Other high-risk areas — shallow sheet flooding, ponding, or floodplain not yet studied in detail.
Unshaded (X)
Moderate-to-low risk — not no risk. Over a quarter of federal flood claims come from outside the high-risk zones.

Live from the National Weather Service and NOAA — the local Doppler loop, the official 7-day forecast, and the next high and low tides. Tides and surge timing decide how bad a coastal flood gets; a storm arriving at high tide floods far more than the same storm at low tide.
